Welcome to Haloo Pro!

These Terms of Use apply to your use of Haloo Pro, along with any associated software applications and websites (all together, “Services”). These Terms form an agreement between you and Haloo Pro. You agree to our Terms of Service (“Terms”) by installing or using our apps, services, or website (together, “Services”).

If you are under the age of 18, you may not download or use our Services. We do not knowingly collect or maintain information from children under age 18. If you are under the age of 18, you must get your parent or guardian to read and agree to our Terms of Service and Privacy Policy. Please, choose carefully the information you post on our Services and the information you provide to other Members. Your Service profile may not include the following items: nude, violent or offensive images or texts. The information posted by other Service Members may contain inaccurate, inappropriate or offensive materials, products or services and Service assumes no responsibility or liability for this material.

We reserve the right, in its sole discretion, to reject, refuse to post or remove any posts (including email) by you, or to restrict, suspend, or terminate your access to all or any part of the mobile application and website and/or Services at any time, for any or no reason, with or without prior notice, and without liability.

1. General

We reserve the right to change these Terms of Service at any time. We will notify you within the app. You are responsible for keeping yourself appraised of any such changes if you dismiss these notifications. If you object to any Terms of Service or any subsequent changes or you become dissatisfied with our Services in any way, your only option is to delete your account. Your continued use of our Services after we post revised Terms of Service means that you agree to the revisions. You must be at least 18 years old to download our Services.

Our Services are free, but your Internet provider’s or mobile operator’s fees and rates may still apply. However, we do have in-app purchases that you can buy if you want to use some of our extra features.

2. Eligibility

• You may only use the App and/or Services if you are eighteen (18) years of age or older and not barred from using the App or receiving the Services under the laws of the applicable jurisdiction, and have the legal capacity and authority to enter into this Agreement and form a binding contract with us;
• You may not use the Products if you are under 18. You may not use the Products if you have been a convicted sex offender, accused or convicted of any human trafficking or modern slavery crime; lacking legal capacity; or legally prohibited, in any way, to use the Products by the laws of the country you reside in.
• Any use, registration or access to the Products by a person who does not fulfill the eligibility requirements above is unauthorized, unlicensed, and in violation of these Terms.
• You represent and warrant that you are fully able and competent to enter into the terms, conditions, obligations, affirmations, representations and warranties set forth in these Terms, and to abide by and comply with the terms and conditions of these Terms.
• We may terminate your account, delete any Content or information that you have posted on the Services, and/or prohibit you from using or accessing the Products (or any part of the Services) if it believes that you do not fulfill the eligibility requirements above.

3. Description of the App and the Services

Our aim is to give people the opportunity and ability to connect with others around the world with real time connections and meaningful conversations. To support this aim we provide Products, (Apps and Services) as described below.

Enable you to connect and communicate with people and friends effectively. We help you connect and find people and friends across our platforms. We use the data we have to help make personalised relevant and meaningful connections and conversations. We use and have developed technologies and designed our systems so that your experience is consistent and seamless to help you connect and share, through live video, chat, text, sharing photos, interests, music, videos and conversation.

Research ways to make our Products and Apps better. We constantly look to improve our Products and carry out research in order to develop and test our Products and provide new ones. This includes analyzing data about our users and understanding how they use our Products. This includes developing advanced technologies such as artificial intelligence, machine learning systems and augmented reality, so that our Products can be used safely – for example to improve our ability to detect and remove illegal content.

Safety. Safety on our site is very important to us. We deploy technical systems supported by dedicated teams to detect misuse of our Products. Where we learn of improper content or conduct, we take action, including, but not limited to blocking or disabling accounts. We share data with our affiliates and third parties when we detect improper content or conduct.

Enable global access to our Products. To operate our Products on a global basis we need to store and distribute data around the world, including outside your country of residence. This infrastructure includes third parties who help support our Products as well as our Affiliates.

Your Use of your Device

3.1 You warrant that you own the Device to which you are downloading the App, or that you have the legal right to control the use of that Device. You further agree to ensure that any other person whom you permit to use the Products will do so in accordance with these Terms.

New Versions of the App

3.2 We can choose to add additional features or functions, or to modify the Products in any other way, for instance to improve performance, enhance functionality, address changes to the operating system or address security issues.

3.3 You may have to agree to a renewed version of the Terms in the event you want to download, install or use any additional features or functions or any modifications, updates or new versions of the App.

3.4 You acknowledge that we may automatically issue any additional features, functions, modifications, updates or upgraded versions of the App and, accordingly, may modify, update or upgrade the version of the App that you are using or have installed on your Device. You hereby agree that your Device may automatically request and/or receive such modifications, upgrades or updates.

3.5 We have no obligation to make available to you any additional features or functions or any modifications, updates, support, maintenance or subsequent versions of the App or any of the Services.

No Access to Emergency Services

3.6 The Products are not intended to replace phone lines and as such are not built to support or carry emergency calls to any type of hospitals, law enforcement agencies, medical care units or any other kind of services that connect a user to emergency services personnel or public safety answering points pursuant to applicable local and or national regulatory requirements (“Emergency Services”).

3.7 There are important differences between traditional telephone services and the Products. You acknowledge and agree that:

We are not required to offer access to Emergency Services under any applicable local and/or national rules, regulations or law;

it is your responsibility to purchase, separately from the App, traditional wireless (cellular) or fixed line telephone services that offer access to Emergency Services, and

We are not a replacement for your primary telephone service.

Prevention of Unauthorized Use

3.8 We reserve the right to exercise whatever lawful means it deems necessary to prevent the unauthorized use of the App or Services, including, but not limited to, technological barriers, IP mapping, and directly contacting your wireless (cellular) carrier or device manufacturer regarding such unauthorized use. If any personal data is processed for this purpose, this shall be in accordance with our Privacy Policy.

4. Child Safety Policy

Haloo Pro is steadfast in its commitment to safeguarding the well-being of children and maintaining a platform free from any form of child sexual abuse and exploitation. This policy delineates our rigorous approach to preventing such egregious acts and ensuring the utmost protection for minors.

4.1 Strict Prohibitions

• Unauthorized Content: Any material that depicts, implies, or references minors in a sexual context is categorically forbidden. This encompasses images, videos, textual content, and live broadcasts.
• Predatory Behavior: Engaging in, or attempting to engage in, solicitation, grooming, or any other predatory conduct targeting minors is unequivocally prohibited.
• Information Sharing: The exchange of any personal details of minors that could facilitate their identification or location is strictly banned.

4.2 Vigilant Reporting System

• User-Initiated Reports: We actively encourage our community to report any content or behavior that appears to involve child sexual abuse or exploitation via our dedicated in-app reporting tool.
• Confidential Reporting: Users have the option to submit reports anonymously to protect their identity and ensure their safety.

4.3 Swift and Decisive Action

• Prompt Investigation: All allegations of child sexual abuse and exploitation will be swiftly reviewed by our specialized safety team.
• Collaboration with Authorities: We pledge full cooperation with law enforcement and child protection entities to thoroughly investigate and address reported incidents.
• Account Sanctions: Users found to be complicit in any form of child sexual abuse or exploitation will face immediate account termination, and appropriate legal measures will be pursued.

4.4. Ongoing Commitment to Excellence:

• Periodic Assessments: We will routinely evaluate our safety protocols to ensure their efficacy and relevance.
• Open to Feedback: We welcome insights and suggestions from our user base and experts to continually refine and enhance our child safety policies.

By accessing and using Haloo Pro, you agree to comply with this Child Safety Policy and acknowledge that violations will result in severe repercussions. Together, we can foster a secure and supportive environment for all members of our community.

1. Your Content on Haloo Pro

Haloo Pro may allow users to create, post, transmit, perform, or store messages, text, sound, images, videos, code or other data or materials on the Services (“Content”). You are solely responsible for the Content that you publish or display (hereinafter, "post") on the Service or any material or information that you transmit to other users. By posting any Content to the public areas of the mobile application and website, you hereby grant us the non-exclusive, fully paid, worldwide license to use, reproduce, publicly perform and display such Content on the mobile application and website, including without limitation distributing part or all of the mobile application and website in any media formats and through any media channels.

You represent and warrant that:

• You own the Content posted by you on the mobile application and website or otherwise have the right to grant the license set forth in this sectio.
• Your Content does not violate the privacy rights, publicity rights, copyright rights, or other intellectual property rights of any person. You agree to pay all royalties and fees owing to any person by reason of any Content you post on the mobile application and website.

1. Your data

• We process and store your data in compliance with our Privacy Policy.
• You understand that we can use carrier distributed mobile messaging (SMS) to verify ownership of registered mobile phone numbers in relation to the users of the App or Services. We use carrier distributed mobile messaging for verification purposes and we will do so only in accordance with its Privacy Policy.
• We will use reasonable efforts to store or otherwise retain your Content in relation to the Products.
• You can choose to provide comments, suggestions, or feedback relating to the Products (the “Feedback”) to us through the Feedback submission channels provided to you or the “review” pages of the Application Stores. You agree that we will have an exclusive license to all rights to the Feedback and will be entitled to use the Feedback for any commercial or other purpose whatsoever, without any compensation or attribution to you or any other person. we will not be required to treat any Feedback as confidential. You agree that you do not acquire any right in or to the Products (or any changes, modifications or corrections thereto) by virtue of any Feedback. You also acknowledge that you are responsible for whatever material is submitted by you, including its legality, reliability, appropriateness, originality, and copyright.

1. Paid Services

We offers certain features and services that require payment. By subscribing to or purchasing these paid services, you agree to pay the specified fees at the time of purchase.

You acknowledge that your payment information will be processed securely, and you are responsible for maintaining the confidentiality of your account credentials. We reserve the right to change our pricing at any time, but any changes will not affect services that have already been purchased.

Generally, all purchases are final and nonrefundable, except if the laws applicable in your jurisdiction provide for refunds.

1. Termination

8.1 Termination by You.

You may terminate your use of the Services at any time by uninstalling and deleting the Software from all of your Devices.

8.2. Termination by Haloo Pro.

Without limiting any other remedies, Haloo Pro may limit, suspend, discontinue or terminate this Terms of Use and/or your use of all or any part of the Software and/or Services, with immediate effect, automatically, with or without notice and without recourse to the courts, for any reason or for no reason, including without limitation if Haloo Pro believes that you are (i) in breach of any of the terms of this Terms of Use, (ii) creating problems or legal liabilities (actual or potential), (iii) delinquent with respect to any charges due for a Premium and all kind of paid contents & item Service, (iv) infringing a third party's intellectual property rights, or (v) engaging in fraudulent, immoral or illegal activities. You agree that Haloo Pro is under no obligation to provide the Services, including without limitation any Premium and all kind of paid contents & item Services, and that no Haloo Pro Party shall be liable to you or to any other party for any limitation, suspension, discontinuance, termination or modification of the Software and/or any of the Services.

Consequences of termination

8.3 In case of termination of your account by you or by us, for whatever reason, your license to use the Service will immediately end and any paid Content you may have in your account will be deleted. After termination of your account, you will not be entitled to a refund for any paid Content or Premium Services that were connected to your account prior to termination.

9. Liability

• We are not liable for any damages based on your use of the App or the Services, your ability to use the App or the Services or in any way or for any failures in the App or Services. Your access to and use of the Services and App or any content is at your own risk. You understand and agree that the Services are provided to you on an “As Is” and “As Available basis”.
• If we are liable for any event, this liability shall be limited to direct damages. This means that we are not liable for, among other things, any consequential, indirect or reputational damages, any loss, deletion, destruction or damage of or to your personal rights, your data, your personal data or your device.
• As some jurisdictions do not allow the enforcement of some of the exclusions or limitations set forth in these Terms, some of these exclusions or limitations may not apply to you. In such an event, our liability will be limited to the maximum extent possible under applicable law. Our liability for damages will never exceed the amount of € 150,- per event. These limitations of liability also apply with respect to damages incurred by you by reason of any products or services sold or provided by third parties other than by us and received through or advertised on the App or any of the Services.

10. Safety

10.1 We try hard to keep our Services a safe place for all users. But we can't guarantee it. That's where you come in. By using the Services, you agree that:

● You will not use the Services for any purpose that is illegal or prohibited in these Terms.

● You will not use or develop any third-party applications that interact with the Services or other users' content or information without our written consent.

● You will not use the Services in a way that could interfere with, disrupt, negatively affect, or inhibit other users from fully enjoying the Services, or that could damage, disable, overburden, or impair the functioning of the Services.

● You will not use or attempt to use another user's account, username, or password without their permission.

● You will not solicit login credentials from another user.

● You will not post content that contains pornography, graphic violence, threats, hate speech, guns or other weaponry, or incitements to violence.

● You will not upload viruses or other malicious code or otherwise compromise the security of the Services.

● You will not attempt to circumvent any content-filtering techniques we employ, or attempt to access areas or features of the Services that you are not authorized to access.

● You will not probe, scan, or test the vulnerability of our Services or any system or network.

● You will not encourage or promote any activity that violates these Terms.

10.2 We have the right to investigate and prosecute violations of any of the above, including intellectual property rights infringement and App security issues, to the fullest extent of the law. We may involve and cooperate with law enforcement authorities in prosecuting Haloo Pro users who violate these Terms of Service. You acknowledge that we have the right to monitor your access to or use of the App and/or the Service for operating purposes, to ensure your compliance with these Terms of Service, or to comply with applicable law or the order or requirement of a court, administrative agency or other governmental body.

10.3 We also care about your safety while using our Services. So do not use our Services in a way that would distract you from obeying traffic or safety laws. And never put yourself or others in harm's way.

11. Final Terms

• This Agreement constitutes the entire agreement of agreed items and other relevant matters between both parties. Other than as stipulated by this Agreement, no other rights are vested in either Party to this Agreement.
• If any provision of this Agreement is rendered void or unenforceable by competent authorities, in whole or in part, for any reason, the remaining provisions of this Agreement shall remain valid and binding.
• The headings within this Agreement have been set for the sake of convenience, and shall be disregarded in the interpretation of this Agreement.
